Rules and Regulations

  • RULES and REGULATIONS:       

    1. The Silicon Valley Duck Race is conducted by El Camino Hospital Foundation (ECHF), a non-profit organization under Section 501 (c)(3) of the Internal Revenue Code. ECHF serves clients without regard to race, religion, ethnicity, or ability to pay.

    2. 15,000 ducks will be entered in the race. The quantity of ducks raced is subject to change at the discretion of the ECHF Duck Race Steering Committee. Chances of winning depend on the total number of qualified entries.

    3. Once the ducks are launched, there will be no attempt to free or interfere with any duck while the race is in progress, unless deemed necessary by the Race Committee.

    4. All ducks for the Silicon Valley Duck Race will launch into Vasona Lake, Los Gatos, CA at approximately 1:30 pm on Sunday, June 10, 2012. The race course will be established by ELHF Duck Race Committee. ECHF reserves the right to postpone or reschedule the race or to determine the winners by random drawing in the event of inclement weather, Acts of God, or other circumstances beyond ECHF’s control.

    5. A number will be attached on the bottom of each duck relating to the number on the sponsorship papers. The person’s name appearing on the sponsorship papers corresponding to the ducks in order of finish and gathered in the duck trap will be awarded prizes. Prize winners will be announced following the race. Winners need not be present to win. Positive identification and a properly completed IRS Form W-9 will be required to claim any prizes. Winners not present will be notified by mail and must pick up their prize from ECHF by July 20, 2012. If a winner does not claim his or her prize from ECHF by 5:00 pm, July 20, 2012, ECHF will select an alternate winner through a random drawing of sponsorship forms.

    6. A copy of the complete Rules and Regulations, a list of prizes and, after the event, a list of prize winners can be obtained at www.siliconvalleyduckrace.org or by sending a written request with self-addressed envelope to El Camino Hospital Foundation, 2500 Grant Road, PAR116, Mountain View, CA 94040.

    7. The entry portion of each sponsorship paper must be completed in its entirety and delivered to ECHF or an authorized representative of ECHF or mailed to ECHF at the address set forth in Rule 6 (Six) and actually received by ECHF by 12:00 pm Thursday, June 7, 2012 to be eligible to receive any prizes. Entries received after 12:00 pm June 7, 2012 or any entries purchased on race day are subject to the availability of ducks, and in the event the number of these entries exceeds the available ducks, these entrants will not be eligible to win any prizes. ECHF cannot guarantee that any entry received after these deadlines will be eligible to win any prizes. Except as otherwise provided for by ECHF, no other entrants are eligible to win any prizes. Entrants assume the risk of non-delivery of any entries to ECHF or to an authorized representative of ECHF. ECHF is not responsible for entries lost in the mail.

    8. Prize winners must be over 18 years of age and must pay any applicable sales tax or other fees associated with any prize received.
    9. No cash equivalent prizes or exchanges will be provided, unless at the discretion of the ECHF Duck Race Steering Committee. Specific qualifications are necessary for certain prizes. Any taxes and/or fees are the responsibility of the winner.

    10. By entering, winners consent to the promotional use of their names and likenesses without any additional compensation.

    11. Due to value received, entries are not considered tax deductible by the IRS.

    12. A minimum of $5 per duck is requested. Free entries defeat the charitable fund-raising purpose of this event and are not encouraged. No purchase is necessary and any person may, prior to 12:00 pm on Thursday, June 7, 2012, request one free entry per person by submitting a written request for such entry and a self-addressed stamped envelope to the mailing address listed in Rule 6 (Six). Requests for free entries will not be accepted after 12:00 pm on Thursday, June 7, 2012 or after the allotted number of ducks have been purchased.

    13. The “Million Dollar Duck” winner will be randomly selected as a potential winning million dollar duck by SCA Promotions, Inc. (SCA). One duck in every 3,333 ducks in the duck race will be selected by SCA. The winning duck numbers are selected prior to the race and kept in a sealed, secured envelope. When the pre-selected sponsored duck number crosses the finish line, a race official will determine whether the duck is one of the pre-selected million dollar winning ducks. If it is, the duck sponsor wins the million dollar prize. If it is not, the million dollar prize will not be awarded. The odds of winning are 1:3333. The million dollar prize is paid in 25 equal installments of $40,000 each without interest. The Million Dollar prize award is the sole responsibility of SCA. Neither ECHF nor the Million Dollar Duck sponsor shall have any liability to any million dollar duck winner.

    14. ECHF Duck Race Steering Committee members and their immediate families, and ECHF employees and their immediate families, are not eligible to win any prizes from this event.

    15. By entering, the entrants release ECHF, its officers, directors, volunteers, staff, and other related entities from any and all liability regarding the festival, prizes, and race.

    16. All decisions and interpretations of rules and regulations will be made by the ECHF Duck Race Steering Committee and its judgment is final. Rules and Regulations can be changed at the discretion of the ECHF Duck Race Steering Committee. A current version may be found at www.siliconvalleyduckrace.org

    17. The Silicon Valley Duck Race is a registered trademark of GAME and cannot be used or copied without its written.
